1. Acceptance of Terms

Welcome to PermitReady! These Terms of Service ("Terms") are a legal agreement between you and TechSmog ("we," "us," or "our") governing your use of the PermitReady mobile application (the "App").

By downloading, installing, or using PermitReady, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Parental Consent for Minors

PermitReady is designed for teenagers preparing for their driver's permit exam. If you are under 18 years of age, you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Parents and guardians are responsible for monitoring and supervising their minor children's use of PermitReady.

2. Description of Service

PermitReady is an educational mobile application that provides practice questions and study tools to help users prepare for driver's permit exams in 13 U.S. states: Massachusetts, California, Texas, Florida, New York, Pennsylvania, Illinois, Ohio, North Carolina, Michigan, Georgia, New Jersey, and Virginia.

Important Clarifications

• PermitReady is NOT affiliated with, endorsed by, or sponsored by any Department of Motor Vehicles (DMV), Registry of Motor Vehicles (RMV), or government agency.
• PermitReady is an educational study tool, not an official practice test or certification program.
• PermitReady does NOT replace official study materials provided by your state's DMV/RMV.
• PermitReady does NOT guarantee that you will pass your official permit exam.
• Practice questions are based on publicly available driver handbook information and may not reflect the exact format or content of your state's official exam.

3. Eligibility & Age Requirements

To use PermitReady, you must:

• Be at least 15 years of age
• If under 18, have the consent of a parent or legal guardian
• Have the legal capacity to enter into this agreement
• Not be prohibited from using the App under applicable laws

COPPA Compliance

PermitReady is intended for users age 15 and older. We do not knowingly collect personal information from children under 13 years of age. The App does not require account creation, login, or submission of personal information. Please see our Privacy Policy for more information.

4. License & Permitted Use

Subject to your compliance with these Terms, TechSmog grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use PermitReady on your personal iOS device solely for your own personal, non-commercial use.

You MAY:

• Use the App to study for your permit exam
• Take unlimited practice quizzes and tests
• Track your study progress on your device
• Purchase the ad-free version for personal use

You MAY NOT:

• Copy, reproduce, or redistribute the App's content or question banks
• Modify, adapt, translate, or create derivative works from the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose or profit
• Extract, scrape, or harvest questions using automated means
• Sell, rent, lease, or sublicense access to the App
• Remove or alter any copyright, trademark, or proprietary notices

5. Prohibited Conduct

When using PermitReady, you agree NOT to:

• Violate any applicable laws or regulations
• Infringe on any third-party rights, including intellectual property rights
• Use automated scripts, bots, or scrapers to extract content
• Attempt to circumvent any security features or access controls
• Interfere with or disrupt the App's functionality
• Use the App in any way that could harm minors
• Misrepresent your affiliation with any person or entity
• Create derivative study materials using our question banks for commercial sale

6. In-App Purchases

PermitReady offers an optional in-app purchase to remove advertisements:

• Ad-Free Version: $4.99 (one-time purchase)

Purchase Terms

• All purchases are processed through Apple's App Store and are subject to Apple's Terms of Service
• We do not receive or store your payment information—Apple handles all transactions
• The ad-free upgrade is a permanent, one-time purchase (not a subscription)
• All purchases are final and non-refundable, except where required by applicable law or Apple's refund policy
• For refund requests, please contact Apple directly through the App Store

Refund Policy

Due to the digital nature of the ad-free purchase and its immediate delivery, all sales are final. TechSmog does not offer refunds for in-app purchases. If you believe you are entitled to a refund under Apple's policies, please submit a refund request directly through the App Store.

7. Third-Party Services

PermitReady integrates with the following third-party services:

Google AdMob (Advertising)

The free version of PermitReady displays advertisements through Google AdMob. By using the free version, you acknowledge that:

• Google may collect device identifiers and usage data for ad personalization
• You are subject to Google's Privacy Policy and Terms of Service
• We do not control the content of third-party ads displayed
• You can remove ads by purchasing the ad-free version

Apple App Store

PermitReady is distributed through Apple's App Store. Your use of the App Store is governed by Apple's Terms of Service. All in-app purchases are processed by Apple.

PermitReady may contain links to external websites (such as official DMV/RMV sites). We are not responsible for the content, privacy practices, or terms of service of third-party websites. We encourage you to review their policies before providing any personal information.

8. Disclaimers & Liability Limitations

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.

Educational Purposes Only

PermitReady is provided as an educational study aid. We make no representations or warranties that using PermitReady will result in passing your official driver's permit exam. Your success depends on many factors, including your study habits, understanding of traffic laws, and the specific requirements of your state's exam.

No Official Affiliation

PermitReady is NOT an official DMV/RMV testing platform. We are not affiliated with, endorsed by, or sponsored by any government agency. Official permit exams are administered solely by state DMV/RMV agencies.

Content Accuracy

While we strive to provide accurate and up-to-date practice questions based on publicly available driver handbooks, we cannot guarantee that:

• Questions reflect the current format or content of your state's official exam
• All information is complete, accurate, or current
• Practice test scores will correlate with official exam performance

Always verify current requirements and regulations with your state's official DMV/RMV website before taking your official exam.

No Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy, reliability, or completeness of content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHSMOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Costs of obtaining substitute services
• Failure to pass an official permit exam
• Delays in obtaining a driver's license
• Time spent studying or using the App
• Emotional distress or disappointment

IN NO EVENT SHALL TECHSMOG'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE PAST 12 MONTHS (MAXIMUM $4.99).

State-Specific Rights

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such states, our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless TechSmog, its officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or share through the App
• Use of the App by minors under your supervision

Parents and guardians agree to indemnify TechSmog for any claims arising from their minor child's use of PermitReady.

10. Intellectual Property

All content, features, and functionality of PermitReady, including but not limited to:

• Practice questions and answer explanations
• Software code and architecture
• User interface and design elements
• Graphics, logos, and trademarks
• Text, images, and multimedia content

...are owned by TechSmog or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

PermitReady, the PermitReady logo, and other TechSmog trademarks are the property of TechSmog. You may not use these trademarks without our prior written permission.

User Rights

You retain no ownership rights to the App's content. Your license to use the App does not grant you any intellectual property rights.

11. Updates & Changes

App Updates

We may update PermitReady from time to time to:

• Add new features or content
• Fix bugs or improve performance
• Update practice questions to reflect current regulations
• Enhance security or compatibility

Updates may be automatic or require manual download. Continued use of the App after updates constitutes acceptance of changes.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Updating the "Last Updated" date at the top of this page
• Displaying a notice in the App (when feasible)
• Sending a notification if you have provided contact information

Your continued use of PermitReady after changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

Pricing Changes

We reserve the right to modify the price of the ad-free in-app purchase at any time. Price changes will not affect purchases already made.

12. Termination

Your Right to Terminate

You may stop using PermitReady at any time by deleting the App from your device. This will remove all locally stored data, including your study progress.

Our Right to Terminate

We reserve the right to suspend or terminate your access to PermitReady at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or unlawful activity
• Abuse or misuse of the App
• Scraping or unauthorized data extraction

Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must delete the App from all devices
• In-app purchases are non-refundable, even if your access is terminated
• Sections of these Terms that by their nature should survive termination will remain in effect (including disclaimers, limitations of liability, and indemnification)

13. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts and the United States, without regard to conflict of law principles.

Dispute Resolution

Please read this section carefully. It affects your legal rights.

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of PermitReady, you agree to first contact us at [email protected] to attempt to resolve the dispute informally.

Arbitration Agreement

If we cannot resolve a dispute informally within 30 days, you and TechSmog agree that any dispute will be resolved through binding arbitration, rather than in court, except that:

• Either party may bring a claim in small claims court if it qualifies
• Either party may seek injunctive relief in court for intellectual property infringement

No Class Actions

YOU AND TECHSMOG AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

You agree not to participate in any class action lawsuit or class-wide arbitration related to PermitReady.

Jurisdiction

If arbitration is not enforceable, you agree that any legal action must be brought in the state or federal courts located in Massachusetts, and you consent to the exclusive jurisdiction of those courts.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and TechSmog regarding your use of PermitReady and supersede any prior agreements, understandings, or representations.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and TechSmog's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
